ARTICLE 1: PURPOSE
The purpose of the present General Conditions is to define the rights and obligations of the parties in the context of the online sale of goods and services offered by the company HABEN DESIGN to the Customer, from the order to the delivery, through the payment and the use of services made available on the site
ARTICLE 2: SCOPE OF APPLICATION
These General Conditions govern the sale of products on the day the order is placed by the customer.
ARTICLE 3 : ORDERING
CAPACITY TO CONTRACT
Any Customer wishing to use the site maisonshiiba.fr declares to have the capacity to contract under the conditions described below, that is to say to be an emancipated minor or to have the legal majority and not to be protected in the sense of article 488 of the Civil Code.
Haben Design reserves the right to refuse any order from a Customer with whom there is or appears to be a dispute during the processing of an order, in particular a payment dispute.
ACCEPTANCE OF THE CONDITIONS BY THE CUSTOMER
The present Conditions can be read directly on the websites www.maisonshiiba.fr and www.maisonshiiba.com. On simple request of the Customer, they can also be sent by e-mail.
The fact that the Customer ticks the box "I accept the general terms and conditions of sale", before proceeding with the secure payment, constitutes an irrevocable acceptance which can only be called into question in the cases restrictively provided for in the present general terms and conditions of sale under the paragraph "right of withdrawal". The Customer acknowledges by this act to have read and understood the present Conditions and to accept them.
PLACING AN ORDER
The individual customer can place an order with Haben Design via the Internet 24 hours a day, 7 days a week.
The ordering process consists of 6 successive steps. Once the selection of products is made, and the basket validated, the Customer must :
- clearly identify the selected products with the options of scent, size, ... indicated on the sites www.maisonshiiba.fr and www.maisonshiiba.com
- indicate the quantities requested;
- identify himself either by entering his email address and password which are strictly personal, or by mentioning all the information usually requested for an online registration;
- clearly indicate the information necessary for delivery. This concerns in particular the precise address of delivery as well as the possible restrictions of accessibility of the place of delivery (building, floor, digicode, etc);
- indicate the chosen delivery method;
- finally, indicate the chosen method of payment.
Once the payment method has been selected, the Customer must proceed to the payment of his order on the secure interface, which will formalize in a firm and definitive way the sales contract between him and Haben Design.
Any order implies acceptance of the prices and description of the products available for sale. Any dispute on this point will intervene within the framework of a possible exchange and guarantees mentioned below.
In all cases, the online provision of the credit card number and the final validation of the order by the Customer will be considered as proof of the order and the payment of the amounts for the products selected in the order. This validation is worth signature and acceptance of all the operations carried out on the sites www.maisonshiiba.fr and www.maisonshiiba.com.
An e-mail is automatically sent to the customer to confirm the order provided that the e-mail address indicated in the registration form does not contain any error.
The Customer is responsible for verifying the completeness and accuracy of the information provided to Haben Design. Haben Design cannot be held responsible for any input errors and the consequences in terms of delay or error in delivery. In this context, all costs incurred for the reshipment will be charged to the Customer.
The Customer may at any time consult the status of his order by consulting the "My account" section on the www.maisonshiiba.fr and www.maisonshiiba.com websites. This follow-up allows the Customer to know the status of his order, but also the status of shipment or delivery of his packages. This last delivery tracking is done in interface with the Internet tracking means of the carriers. Haben Design cannot therefore be held responsible for any unavailability or errors that may affect the information provided by its carriers. However, Haben Design strives to make this information as clear as possible and to make the transport with its carriers as reliable as possible. The Customer can contact Haben Design's customer service at any time to be informed about the status of his order.
PROOF OF ORDER
The computerized registers, kept in Haben Design's computer systems under reasonable security conditions, shall be considered as proof of communications, orders and payments between the parties.
The archiving of purchase orders and invoices is made on a reliable and durable support that can be produced as evidence.
ARTICLE 4: PRODUCT INFORMATION
The products offered for sale by Haben Design on the Site are described on the Site. They will be the subject of an individual product sheet that will present at least the essential characteristics of the product based on information provided by partners, suppliers or manufacturers. The characteristics will have an indicative value. The products will also be presented in photos, without contractual value. Haben Design may also offer "Promotions": the products concerned (on price or on any other characteristic such as delivery, quantity, etc.) will be sold for a limited period and/or quantity.
Haben Design undertakes to honor orders received only within the limits of available product stocks. If the product(s) are not available, Haben Design undertakes to inform the Customer as soon as possible. Availability may vary on the same day depending on the level of sales. Haben Design updates availability very frequently. In case of unavailability of products, Haben Design will notify the Customer by phone or email.
The unavailability of a product is mentioned on the page of the product concerned and in the summary of the basket. Thus, the products may appear with the mention of the shipping time of the type "in stock" or "immediate", "Product not available" ...
The delivery times indicated in the description sheets are indicative times when the product(s) is (are) not available in Haben Design's stock. They may therefore be subject to variations for which the Customer will be informed by Haben Design in his order tracking in case of a slight delay or by email in case of a prolonged delay.
If Haben Design cannot obtain an ordered product from its suppliers, the company will notify the customer of the expected delay by e-mail. The customer may then request a refund of the amount paid within 30 days of payment, or exchange the unavailable product for another product, or cancel the order. No cancellation penalty will be applied for such an order cancellation. No cancellation penalty (other than a full refund of the Order) may also be claimed, as such unavailability results from the delay in updating such unavailability.
Haben Design shall not be held responsible for the non-performance of the contract entered into in case of stock shortage or unavailability of the product, force majeure, disruption or total or partial strike, in particular of the postal services and means of transport and/or communications, flooding, fire.
ARTICLE 5: PRICE
Maison Shiiba reserves the right to change these prices.
ARTICLE 6: PAYMENT
MEANS OF PAYMENT
The Customer may pay for his order online by credit card (Carte Bleue, Visa, Eurocard-Mastercard) or by Paypal. The Customer guarantees Haben Design that he/she has the necessary authorizations to use the payment method chosen by him/her when validating the order form. Purchases are debited from the customer's account at the time the order is processed.
Haben Design uses all necessary means to ensure the security and confidentiality of data transmitted online. To this end, the site uses a secure SSL (Secure Socket Layer) payment method that encrypts your bank details during transmission over the network. You can see that the transmission is encrypted by a software when the padlock symbol appears in your browser. The transaction is carried out via the Crédit Agricole bank, which alone has the banking information provided on the site at the time of payment.
Haben Design reserves the right to suspend all order processing and deliveries in the event of refusal to authorize payment by credit card by officially accredited organizations or in the event of non-payment. In particular, Haben Design reserves the right to refuse to make a delivery or to honor an order from a customer who has not paid in full or only partially for a previous order or with whom a payment dispute is being administered.
As part of an order verification procedure designed to ensure that no one is using another person's bank details without their knowledge, the Customer may be asked to send a copy of an identity document and proof of address to Haben Design by fax or e-mail. The order will only be validated after receipt and verification by our services of the documents sent. If these documents are not received within 15 days of the order being placed, the order will be considered cancelled as of right.
The order form that Customer makes online or the order confirmation that Haben Design sends by email to Customer does not serve as an invoice. The Customer has the original invoice in his online account. The invoice is not attached to the package.
Haben Design keeps an electronic copy of each invoice.
In the case of a delivery to an address different from the billing address, the invoice is in any case only available in the online order tracking of the Customer account.
TRANSFER OF OWNERSHIP
Haben Design remains the owner of the delivered Products until full payment has been made by the Customer. The above provisions do not prevent the transfer to the Customer of the risks of loss or deterioration of the products subject to retention of title as well as any damage they may cause, upon delivery of the products.
ARTICLE 7: DELIVERY
The geographic delivery area for the Haben Design store's offer is Metropolitan France.
Products are delivered to the address indicated by the Customer on the order form. The Customer is responsible for verifying the completeness and accuracy of the information provided to Haben Design. Haben Design cannot be held responsible for any input errors and the consequences in terms of delay or error in delivery. In this context, all costs incurred for the reshipment of the order will be fully charged to the Customer.
Haben Design shall not be held responsible for delays in delivery due to errors or disruptions attributable to the carriers (including but not limited to total or partial strikes of postal services and means of transport and/or communications).
Orders placed online via www.maisonshiiba.fr and www.maisonshiiba.comsont are collected daily from Monday to Friday, except for holidays. Haben Design does its best to process and ship orders, however, the processing and preparation time of an order may be longer depending on the items and may take between 1 and 2 business days. Upon receipt of the shipment confirmation email, the Customer can take into account the carrier delays announced below.
Haben Design informs its customers that these shipping times do not include Saturdays, Sundays and holidays.
In the case of an order that includes one or more unavailable products as well as one or more available products, Haben Design will ship the order upon receipt of all products that make up the order. If the Customer wishes to receive the immediately available products as soon as possible, he is advised to isolate these items in a specific separate order.
An e-mail is automatically sent to the Customer at the time of shipment of the Products provided that the e-mail address indicated in the registration form does not contain any error.
Transport times depend on the carrier chosen by the Customer and the place of delivery.
Haben Design informs Customers of the delivery times announced by the chosen carrier. The shipping costs are calculated according to the delivery chosen at the time of the shopping cart and are definitively confirmed according to the chosen mode of transport and delivery destination, before the final validation of the order.
However, Haben Design informs its Customers that the announced deadlines do not include Saturdays, Sundays and holidays.
Delivery times can be as follows:
– If the products are available, the delivery time is equal to the time indicated when the order was placed in the delivery method section
– If the products are not available and therefore on order, the delivery time is equal to the time indicated in the product availability section
If it turns out that the delivery time cannot be met, a new delivery time will be communicated to the Customer, according to the data known by Haben Design. In this case, a proposal for order cancellation, credit note or refund will also be made to the Customer.
MEANS OF DELIVERY IN METROPOLITAN FRANCE
Delivery in Relais Colis (Usually 48h delay)
This method of delivery allows the customer to receive his parcel in the Relais Colis closest to his home within 24 to 72 hours from Tuesday to Saturday, excluding holidays. The order must be placed from Monday to Friday before 11 am for a delivery from the next day afternoon (except holidays). Orders placed from Friday afternoon to Sunday included, will be delivered from Tuesday afternoon. The customer is notified by e-mail as soon as the parcel arrives at the chosen delivery point. The parcel remains available for 10 working days and 14 calendar days. Beyond this period, the package will be returned to our warehouses.
Delivery by Mondial Relay (Usually 5 days)
Delivery is made to the customer's home within 3 to 5 days. The carrier will contact the customer 48 to 72 hours after delivery of the goods to the carrier, to arrange a delivery appointment at his home. The customer must take care to inform during his order the conditions of access of the place of delivery (code, building, floor...), as well as a telephone number where to be easily reachable. In case of absence, the deliveryman will leave a notice of passage with a telephone number to call to arrange a second passage free of charge. This method of delivery is suitable for very large items that require two drivers (up to 130kg). The deliverymen will drop the parcels on the floor if necessary, in the room chosen by the customer.
Standard delivery by Colissimo (usually 48h delay)
This method of delivery allows the Customer to receive his parcel within 48 hours from the time of shipment thanks to the Post Office and the Colissimo Expert or Profil service (excluding the time required to process and prepare the order, which can take from 1 to 2 days). Deliveries are made from Monday to Saturday morning, except on public holidays. The costs incurred for this option depend on the weight and total volume of the items ordered.
The package is taken in charge by the Post Office and given against signature to the delivery address indicated by the Customer. In case of absence at the time of delivery, a notice of passage is left at the delivery address indicated by the Customer, which allows the latter to withdraw his parcel in the nearest post office. Products will be held at the post office for 15 calendar days. In the event that the products are not picked up within the time given by the carrier, they will be returned to Smallable, which reserves the right to refund the price of the products, with shipping costs remaining the responsibility of the Client.
Express delivery by Chronopost (usually 24 hours)
This method of delivery allows the Customer to receive his package within 24 hours from the date of shipment thanks to Chronopost (excluding the time required to process and prepare the order which may take 1 to 2 days). Deliveries are made from Monday to Friday, except on public holidays. The cost of this option depends on the weight and total volume of the items ordered.
The parcel is picked up by Chronopost and delivered against signature to the delivery address indicated by the Customer. The Customer must ensure that he/she provides information on the access conditions to the delivery address (code, building, floor, door, etc.), as well as a telephone number where the Customer can be easily reached. In case of absence, a notice of passage is left at the delivery address indicated by the Customer, which allows the latter to withdraw his parcel at the address and according to the terms indicated by the carrier. The packages are kept pending at the Post Office for 15 calendar days. In the event that the package is not picked up within the time limit set by the carrier, the products will be returned to Smallable, which reserves the right to reimburse the price of the products, with the shipping costs remaining the responsibility of the Customer.
The products are packaged in such a way as to comply with current transport standards, and to ensure optimum protection of the products during their delivery. It is asked to the customer to respect these same standards during a return of product that it is during an after-sales service, or during a return for convenience. In case of a product return, if we find that the product is returned to us damaged due to insufficient packaging, Haben Design may decide to refund only part of the product or refuse to refund it if it cannot be resold in its original condition.
CUSTOMER RESPONSIBILITY FOR CHECKING PACKAGES ON RECEIPT
Haben Design reminds you that it is the Customer's responsibility to inspect his packages upon receipt in the presence of the delivery person and to immediately notify the carrier and Haben Design's customer service department of any anomaly found (shock, damaged package, delivery date not in accordance with the normal delivery service deadlines. In case such remarks have not been made on the delivery note presented to the Customer by the carrier, no claim regarding the condition of the package(s) can be accepted a posteriori by Haben Design.
DELAYS IN DELIVERY RELATED TO THE CARRIER
In the event of a delay in delivery in relation to the times announced by the carriers, the Customer must first contact the carrier or its distribution office in the case of the Post Office, to see if the package is not pending. If necessary, the Customer may contact Haben Design Customer Service by phone or email to open a dispute or investigation file to search for the package.
Sometimes packages are lost by carriers. The time limits imposed by the carriers require that the Customer declares the loss within 10 days of receiving the shipping notice from Haben Design. Under these conditions, Haben Design will make the necessary claims to the carrier concerned. Once the claim and the investigation are done, it can take 3-4 weeks to get a return from the carrier.
If the package is found, it will be sent back to the Customer's home immediately. In case the parcel is not found, the Customer may then request the return of the same product (within the time of availability), at Haben Design's expense, or the refund of the amount paid. If the product(s) ordered were no longer available at that time, Haben Design will refund the amount of the products concerned by the loss of the carrier.
The Customer must check the condition of the package in front of the carrier and make the necessary reservations on the delivery slip in case of partial or total deterioration. If no reservations are made, the product is deemed accepted by the Customer and cannot be disputed in any way regarding its delivery. Customer shall inform Haben Design by e-mail as soon as possible, so that Haben Design can take the necessary measures as soon as possible.
ARTICLE 8: RIGHT OF WITHDRAWAL, RETURN AND EXCHANGE
8.1 Legal withdrawal period
In accordance with the provisions of Articles L.221-16 et seq. of the Consumer Code, the Customer has a withdrawal period of fourteen (14) calendar days from the date of receipt or collection of the Articles to exercise its legal right of withdrawal and thus notify Haben Design of its intention to return the said Article. If the Items are eligible for the legal right of withdrawal, the Customer exercising his right of withdrawal under the conditions provided for in this article in terms of the time and manner of return of the Items, may obtain a refund of the returned Items. Form available in CGV Article 10.4.
The refund will be made by the same means of payment as the one used by the Customer for the initial transaction, unless the Customer specifically requests a credit note, valid for six (6) months from its issue. The refund will be made as soon as possible and at the latest within 14 days following the effective exercise of the right of withdrawal by the Customer. This period may however be extended by Haben Design until Haben Design has received and checked the goods returned by the Customer to the address indicated on the return form, or until Haben Design has received proof of shipment of the Articles by the Customer. Where the fourteen (14) day period expires on a Saturday, Sunday or public holiday, it shall be extended to the next business day.
Promotion period: During promotional periods, table, bench and bar legs are neither exchangeable nor refundable.
Please read carefully the indications on the thickness of the boards, technical characteristics of the foot, the choice of the color.
Concerning the candles, they are neither refundable nor exchangeable because of the personalization.
In accordance with Article L.221-23 of the Consumer Code, the right is exercised by returning the Article, only the shipping costs remain payable by the Customer.
Customers are entitled to a prepaid return voucher in accordance with Article 15 hereof, and (2) in case of non-conformity of the delivered Items with the Order (in this case, the return costs shall be borne by Haben Design).
The right of withdrawal is exercised under the same conditions from the Order and before the Delivery.
8.2 Contractual withdrawal period
In order to ensure customer satisfaction, Haben Design accepts returns by post to the address indicated by Customer Service or on the delivery note of the Article concerned, within a period longer than the above-mentioned legal retraction period. In this respect, the Customer has fourteen (14) days as from the date of reception of his order to retract and return his Articles. The returns of Articles beyond this period will not be accepted.
8.3 How to exercise the right of withdrawal
To do this, the Customer simply has to choose one of the following methods:

- Either by logging on to the websites www.maisonshiiba.fr and www.maisonshiiba.com, in the "Manage my orders" section of My Account: simply check the product and quantities to be returned, fill in the reason for the return and validate by clicking on "Validate your return request". A link will be available for the customer to download the prepaid label.
- Or by contacting the customer service, by the contact form, by e-mail or by telephone which will indicate to the Customer the methods to be followed, it will be able in particular to use the form of retraction appearing below

Haben Design suggests the Customer to return the products by registered mail or with additional insurance, which guarantees, if necessary, compensation of the products up to their real market value in case of spoliation or loss of the goods. In all cases, the return is at the Customer's risk. It is up to the Customer to keep all proof of return. The return costs are at the expense of the customer, who is free to choose the shipping method.

ARTICLE 9: GUARANTEES, MEDIATION CLAIM
In accordance with article 4 of the decree n°78-464 of March 24, 1978, the provisions of the present cannot deprive the Customer of the legal guarantee which obliges the professional salesman to guarantee him against all the consequences of the hidden defects of the sold thing.
The Customer is expressly informed that Haben Design is not the manufacturer of the products presented on the www.maisonshiiba.fr and www.maisonshiiba.com websites, within the meaning of Law No. 98-389 of May 19, 1998 on liability for defective products.
Consequently, in case of damage caused to a person or property by a defective product, only the manufacturer's responsibility can be sought by the Customer, based on the information on the packaging of said product. In addition, the company reminds you that the products, services and information offered by Haben Design are no substitute for constant adult supervision.
Haben Design cannot be held responsible for non-compliance with the laws of the country where the products are delivered. It is the customer's responsibility to check with local authorities about the possibility of importing or using the products or services you plan to order.
COMPLAINT / MEDIATION
Any complaint must be made in advance by e-mail via the "Customer Service" section of the Site or by telephone to Customer Service.

If applicable, the refund will be made within 14 days upon receipt of the Article by Haben Design according to the payment method chosen at the time of the Order, either on the credit card used for the payment, or on the Customer's PayPal account, or by bank transfer. These provisions are not exclusive of the above-mentioned right of withdrawal.
It is specified that Haben Design adheres to the Code of Ethics of the FEVAD (Fédération du E-Commerce et de la Vente A Distance) and to the E-Commerce mediation system of this federation.

ARTICLE 10: RESPONSIBILITY
The products offered comply with the French legislation in force and the standards applicable in France. Haben Design cannot be held responsible for non-compliance with the legislation of the country where the product is delivered. It is the Customer's responsibility to check with the local authorities the possibilities of importing or using the products you plan to order.
Haben Design shall not be liable for any inconveniences or damages related to the use of the Internet network, such as a break in service, the presence of computer viruses or external intrusions, and more generally any case qualified by the courts as force majeure or a third party act.
Hypertext links may lead to sites other than www.maisonshiiba.fr and www.maisonshiiba.com declines all responsibility in the event that the content of these sites contravenes the legal and regulatory provisions in force.
ARTICLE 11: FORCE MAJEURE
Neither party shall have failed to perform its contractual obligations to the extent that their performance is delayed, hindered or prevented by a fortuitous event or force majeure.
Will be considered as fortuitous event or force majeure all facts or circumstances irresistible, external to the parties, unforeseeable, unavoidable, independent of the will of the parties and which could not be prevented by the latter, despite all the efforts reasonably possible.
The party affected by such circumstances will notify the other party within ten business days of becoming aware of the circumstances.
The two parties will then meet, within a period of one month, except in the event of force majeure, to examine the impact of the event and agree on the conditions under which the performance of the contract will be continued.
If the force majeure event lasts longer than three months, these terms and conditions may be terminated by the injured party.
Expressly, are considered as force majeure or fortuitous events, in addition to those usually retained by the jurisprudence of the French courts and tribunals:
– Total or partial strikes, internal or external to the company, blockage of means of transport or supplies for any reason whatsoever, governmental or legal restrictions, computer breakdowns, earthquakes, fires, storms, floods, lightning;
– Stoppage of telecommunication networks or difficulties with telecommunication networks external to the Clients.
ARTICLE 12: PERSONAL DATA
The visitors or Customers of the sites www.maisonshiiba.fr and www.maisonshiiba.comdisposent at any time of a right of access, of modification, correction and suppression of the data which concern them in application of article 34 of the law "data processing and freedoms" of January 6, 1978.
When the Customer registers or places an order, or in the context of other specific operations, Haben Design offers Visitors or Customers the opportunity to receive its newsletters, promotional offers, and/or to register to be informed of its exclusive sales. The Visitor or Customer may at any time modify his subscription through his personal account, or through the hyperlink at the bottom of the newsletters received by e-mail.
Haben Design undertakes to effectively take into account changes in subscriptions and unsubscriptions to commercial e-mails sent by Haben Design as soon as possible according to the necessary processing.
Haben Design may also offer its Visitors or Customers to receive promotional offers from its partners. Haben Design may for commercial purposes pass on the identity and contact details of its Users or Customers to commercial partners, only to the extent that they have agreed to the disclosure of their personal data. Users and Customers can change their choices at any time on the Haben Design website.
Haben Design uses data collection systems such as cookies. A cookie is a computer file stored on the user's computer hard drive. Cookies make it possible to report a user's previous visit to the site and to link the user to his or her personal data left on the site, in particular for the purpose of identifying the shopping cart.
ARTICLE 13: INTELLECTUAL PROPERTY
The entire content (texts, comments, works, illustrations, images, videos, graphics, sounds... including the underlying technologies used) displayed on the present site is reserved under copyright law as well as under intellectual property law and for the whole world. In this respect and in accordance with the provisions of the Intellectual Property Code, only use for private purposes is authorized, subject to different and even more restrictive provisions of the Intellectual Property Code. Any other use constitutes an infringement and is punishable under the Intellectual Property Code unless prior authorization is obtained from Haben Design. Any total or partial reproduction of the Haben Design catalog is strictly prohibited.

These Terms and Conditions apply for the duration of the online services offered by Haben Design. They may be modified at any time by Haben Design. The applicable Terms are those in effect on the date of the order registration.

Haben Design's product sales are subject to French law. In the case of a private customer, any dispute concerning the existence, interpretation, performance or breach of contract between Haben Design and the customer, even in the case of multiple defendants, shall, in the absence of an amicable agreement, be subject to the exclusive jurisdiction of the court of the customer's domicile. In the case of a professional Customer, any dispute relating to the existence, interpretation, performance or termination of the contract between Haben Design and the Customer, even in the event of multiple defendants, shall, in the absence of an amicable agreement, be under the exclusive jurisdiction of the courts of Paris.
