ARTICLE 1: PURPOSE

The purpose of these General Conditions is to define the rights and obligations of the parties in the context of the online sale of goods and services offered by the company HABEN DESIGN to the Customer, from the order to the delivery, including payment and the use of services made available on the site habenmetal.fr

ARTICLE 2: SCOPE OF APPLICATION

These General Conditions govern the sale of products on the day the order is placed by the customer.

ARTICLE 3 : ORDERING

CAPACITY TO CONTRACT

Any Customer wishing to use the site maisonshiiba.fr declares that they have the capacity to contract under the conditions described below, that is to say, they are an emancipated minor or of legal age and not be protected within the meaning of article 488 of the Civil Code.
Haben Design reserves the right to refuse any order from a Customer with whom a dispute exists or arises during the processing of an order, in particular a payment dispute.

ACCEPTANCE OF THE CONDITIONS BY THE CUSTOMER

The present Conditions can be read directly on the websites www.maisonshiiba.fr and www.maisonshiiba.com. On simple request of the Customer, they can also be sent by e-mail.
The fact that the Customer checks the box "I accept the general conditions of sale", before proceeding with the secure payment, constitutes an irrevocable acceptance which can only be challenged in the cases strictly provided for in these general conditions of sale under the paragraph "right of withdrawal". The Customer acknowledges by this act having read and understood these Conditions and accepts them.

PLACING AN ORDER

The individual customer can place an order with Haben Design via the Internet 24 hours a day, 7 days a week.
The ordering process consists of 6 successive steps. Once the selection of products is made, and the basket validated, the Customer must :
- clearly identify the selected products with the options of scent, size, ... indicated on the sites www.maisonshiiba.fr and www.maisonshiiba.com
- indicate the quantities requested;
– identify themselves either by entering their email address and password, which are strictly personal, or by providing all the information usually requested for online registration;
– clearly indicate the information required for delivery. This concerns in particular the precise delivery address as well as any accessibility restrictions at the delivery location (building, floor, digital code, etc.);
- indicate the chosen delivery method;
- finally, indicate the chosen method of payment.
Once the payment method has been selected, the Customer must pay for their order on the secure interface, which will formalize in a firm and definitive manner the sales contract which binds them to Haben Design.
Any order implies acceptance of the prices and description of the products available for sale. Any dispute on this point will occur within the framework of a possible exchange and the guarantees mentioned below.
In all cases, the online provision of the credit card number and the final validation of the order by the Customer will be considered as proof of the order and the payment of the amounts for the products selected in the order. This validation is worth signature and acceptance of all the operations carried out on the sites www.maisonshiiba.fr and www.maisonshiiba.com.

ORDER CONFIRMATION

An email is automatically sent to the customer to confirm the order, provided that the email address indicated in the registration form does not contain any errors.
The Customer must verify the completeness and conformity of the information provided to Haben Design. The latter cannot be held responsible for any data entry errors and the consequences in terms of delay or delivery error. In this context, all costs incurred for reshipping will be borne by the Customer.

ORDER TRACKING

The Customer can check the status of his order at any time by consulting the "My account" section on the websites www.maisonshiiba.fr and www.maisonshiiba.com. This tracking allows the Customer to know the processing status of his order, but also the shipping or delivery status of his packages. This last delivery tracking is carried out in interface with the Internet tracking means of the carriers. Haben Design cannot therefore be held responsible for unavailability, or errors that may affect the information provided by its carriers. Haben Design nevertheless strives to make this information as clear as possible and to make the transport as reliable as possible with its carriers. The Customer can contact Haben Design customer service at any time to be informed of the tracking of his order.

PROOF OF ORDER

The computerized registers, kept in Haben Design's computer systems under reasonable security conditions, shall be considered as proof of communications, orders and payments between the parties.
The archiving of purchase orders and invoices is carried out on a reliable and durable medium that can be produced as proof.

ARTICLE 4: PRODUCT INFORMATION

PRODUCT FEATURES

The products offered for sale by Haben Design on the Site are described on the Site. They will be the subject of an individual product sheet that will present at least the essential characteristics of the product based on information provided by partners, suppliers or manufacturers. The characteristics will have an indicative value. The products will also be presented in photos, without contractual value. Haben Design may also offer "Promotions": the products concerned (on price or on any other characteristic such as delivery, quantity, etc.) will be sold for a limited period and/or quantity.

PRODUCT AVAILABILITY

Haben Design undertakes to honour orders received only within the limits of available stocks of the products. In the event of unavailability of the product(s), Haben Design undertakes to inform the Customer as soon as possible. Availability may vary within the same day depending on the level of sales. Haben Design updates availability very frequently. In the event of unavailability of the products, Haben Design will notify the Customer by telephone or email.
The unavailability of a product is mentioned on the page of the product concerned and in the summary of the basket. Thus, the products may appear with the mention of the shipping time of the type "in stock" or "immediate", "Product not available" ...
The shipping times indicated in the description sheets are indicative times when the product(s) are not available in Haben Design stocks. They may therefore be subject to variations for which the Customer will be informed by Haben Design in its order tracking in the event of a slight delay or by email in the event of a prolonged delay.
If Haben Design cannot obtain an ordered product from its suppliers, the company will notify the customer of the expected delay by email. The latter may then request a refund of the sums paid within 30 days at the latest of their payment, or the exchange of the unavailable product for another product, or the cancellation of the order. No cancellation penalty will be applied for such an order cancellation. No cancellation compensation (apart from the full refund of the Order) may also be requested, such unavailability resulting from the delay in updating these unavailabilities.
Haben Design cannot be held responsible for the non-performance of the contract concluded in the event of stock shortage or unavailability of the product, force majeure, disruption or total or partial strike, in particular of postal services and means of transport and/or communications, flood, fire.

ARTICLE 5: PRICE

Maison Shiiba reserves the right to change these prices.

ARTICLE 6: PAYMENT

MEANS OF PAYMENT

The Customer can pay for his order online by credit card (Carte Bleue, Visa, Eurocard-Mastercard) or by Paypal. The Customer guarantees Haben Design that he has the authorizations that may be necessary to use the payment method chosen by him, when validating the order form. The debit of purchases on the customer's account is done at the time of processing the order.
Haben Design implements all necessary means to ensure the security and confidentiality of data transmitted online. For this purpose, the site uses a secure SSL (Secure Socket Layer) payment method that allows the encryption of your bank details during their transmission over the network. You will notice that the transmission is encrypted by software when the padlock symbol appears in your browser. The transaction is carried out via the Crédit Agricole bank, which alone has the banking information provided on the site at the time of payment.
Haben Design reserves the right to suspend any order management and delivery in the event of refusal of authorization of payment by credit card from officially accredited organizations or in the event of non-payment. Haben Design reserves the right in particular to refuse to make a delivery or to honor an order from a Customer who has not fully or only partially paid a previous order or with whom a payment dispute is currently being administered.
As part of an order verification procedure designed to ensure that no person uses another person's bank details without their knowledge, the Customer may be asked to send a copy of an identity document and proof of address to Haben Design by fax or email. The order will only be validated after receipt and verification by our services of the documents sent. If these documents are not received within 15 days following the placing of the order, the latter will be deemed to be automatically cancelled.

BILL

The order form that the Customer establishes online or the order confirmation sent by email to the Customer by Haben Design does not serve as an invoice. The Customer has the original of the invoice in his online account. The invoice is not attached to the package.
Haben Design keeps an electronic copy of each invoice.
In the case of delivery to an address other than the billing address, the invoice is in any case only available in the online order tracking of the Customer's account.

TRANSFER OF OWNERSHIP

Haben Design remains the owner of the Products delivered until their full payment by the Customer. The above provisions do not prevent, upon delivery of the products, the transfer to the Customer of the risks of loss or deterioration of the products subject to retention of title as well as any damage they may cause.

ARTICLE 7: DELIVERY

DELIVERY AREAS

The geographic delivery area for the Haben Design store offer is Metropolitan France.

DELIVERY SERVICES

The products are delivered to the address indicated by the Customer on the order form. The Customer must check the completeness and conformity of the information provided to Haben Design. The latter cannot be held responsible for any data entry errors and the consequences in terms of delay or delivery error. In this context, all costs incurred for the reshipment of the order will be entirely borne by the Customer.
Haben Design cannot be held responsible for delays in delivery due to errors or disruptions attributable to carriers (including in the event of a total or partial strike, in particular of postal services and means of transport and/or communications).

SHIPPING TIMES

Orders placed online via the websites www.maisonshiiba.fr and www.maisonshiiba.com are collected every day from Monday to Friday, except public holidays. Haben Design does its utmost to process and ship orders, however the processing and preparation time for an order may be extended depending on the items and last between 1 and 2 working days. Upon receipt of the shipping confirmation email, the Customer can take into account the carriers' delivery times announced below.
Haben Design informs its Customers that these shipping times do not include Saturdays, Sundays and public holidays.
In the case of an order that includes one or more unavailable products as well as one or more available products, Haben Design will ship the order upon receipt of all the products that make up the order. If the Customer wishes to receive the immediately available products as quickly as possible, they are advised to isolate these items in a separate specific order.
An email is automatically sent to the Customer when the Products are shipped, provided that the email address indicated in the registration form does not contain any errors.

TRANSPORT TIMES

Transport times depend on the carrier chosen by the Customer and the place of delivery.
Haben Design informs Customers of the delivery times announced by the chosen carrier. The shipping costs are calculated according to the delivery chosen at the time of the shopping cart and are definitively confirmed according to the chosen mode of transport and delivery destination, before the final validation of the order.
However, Haben Design informs its Customers that the announced deadlines do not include Saturdays, Sundays and holidays.

DELIVERY TIME

Delivery times can be as follows:
– If the products are available, the delivery time is equal to the time indicated when the order was placed in the delivery method section
– If the products are not available and therefore on order, the delivery time is equal to the time indicated in the product availability section
If it turns out that the shipping time cannot be met, a new deadline will then be communicated to the Customer, based on the data known to Haben Design. In this case, a proposal for order cancellation, credit or refund will also be made to the Customer.

MEANS OF DELIVERY IN METROPOLITAN FRANCE

Delivery in Relais Colis (Usually 48h delay)
This method of delivery allows the customer to receive his parcel in the Relais Colis closest to his home within 24 to 72 hours from Tuesday to Saturday, excluding holidays. The order must be placed from Monday to Friday before 11 am for a delivery from the next day afternoon (except holidays). Orders placed from Friday afternoon to Sunday included, will be delivered from Tuesday afternoon. The customer is notified by e-mail as soon as the parcel arrives at the chosen delivery point. The parcel remains available for 10 working days and 14 calendar days. Beyond this period, the package will be returned to our warehouses.

Delivery by Mondial Relay (Usually 5 days)
Delivery is made to the customer's home within 3 to 5 days. The carrier will contact the customer 48 to 72 hours after handing over the goods to the carrier, to arrange a delivery appointment at their home. The customer must ensure that they provide the access conditions for the delivery location (code, building, floor, etc.) when ordering, as well as a telephone number where they can be easily reached. In the event of absence, the delivery person will leave a calling card with a telephone number to call to arrange a second delivery free of charge. This delivery method is suitable for very bulky items that require two delivery people (up to 130 kg). The delivery people will drop off the packages upstairs if necessary, in the room chosen by the customer.

Standard delivery by Colissimo (usually 48h delay)
This delivery method allows the Customer to receive their package within 48 hours of dispatch thanks to the Post Office and the Colissimo Expert or Profil service (excluding processing and preparation time for the order, which can take 1 to 2 days). Deliveries are made from Monday to Saturday morning, except on public holidays. The costs incurred for this option depend on the weight and total volume of the items ordered.
The package is taken care of by the Post Office and delivered against signature to the delivery address indicated by the Customer. In the event of absence at the time of delivery, a delivery notice is left at the delivery address indicated by the Customer, which allows the latter to collect their package from the nearest post office. Packages are kept pending at the Post Office for 15 calendar days. In the event of non-collection within the time limits set by the carrier, the products will be returned to Smallable, which reserves the right to reimburse the price of the products, with the shipping costs remaining the responsibility of the Customer.

Express delivery by Chronopost (usually 24 hours)
This delivery method allows the Customer to receive their package within 24 hours from dispatch thanks to Chronopost (excluding processing and preparation time for the order which can take 1 to 2 days). Deliveries are made from Monday to Friday, except public holidays. The costs incurred for this option depend on the weight and total volume of the items ordered.
The package is handled by Chronopost and delivered against signature to the delivery address indicated by the Customer. The Customer must ensure that when ordering, they provide the access conditions for the delivery location (code, building, floor, door, etc.), as well as a telephone number where the Customer can be easily reached. In the event of absence, a calling card is left at the delivery address indicated by the Customer, which allows the latter to collect their package at the address and according to the terms indicated by the carrier. Packages are kept pending at the Post Office for 15 calendar days. In the event of non-collection within the time limits set by the carrier, the products will be returned to Smallable, which reserves the right to reimburse the price of the products, with the shipping costs remaining the responsibility of the Customer.

CONDITIONING

The products are packaged in such a way as to comply with the transport standards in force, and to ensure optimal protection of the products during their delivery. The Customer is asked to respect these same standards when returning a product, whether for after-sales service, or for a return for convenience. In the event of a product return, if we find that the product is returned to us damaged due to insufficient quality packaging, Haben Design may decide to only partially refund the product or to refuse to refund it in the event of impossibility of resale in the state.

CUSTOMER RESPONSIBILITY FOR CHECKING PACKAGES ON RECEIPT

Haben Design reminds that it is the Customer's responsibility to inspect their packages upon receipt in the presence of the delivery person and to immediately notify the carrier and Haben Design customer service of any anomaly noted (impact, damaged package, delivery date not in accordance with the normal delivery service deadlines). In the event that such information has not been included on the delivery slip presented to the Customer by the carrier, no claim relating to the condition of the package(s) may be accepted a posteriori by Haben Design.

DELAYS IN DELIVERY RELATED TO THE CARRIER

In the event of a delay in delivery compared to the deadlines announced by the carriers, the Customer must first contact the carrier or its distribution office in the case of La Poste, to see if the package is not pending. If necessary, the Customer can contact Haben Design Customer Service by telephone or email in order to open a dispute or investigation file to search for the package.
It happens that packages are lost by carriers. The deadlines imposed by the carriers imply that the Customer declares the loss within 10 days of receiving the shipping notice from Haben Design. Under these conditions, Haben Design is responsible for making the necessary claims with the carrier concerned. Once the claim and the opening of an investigation have been made, it may take 3 to 4 weeks to receive a response from the carrier.
If the package is found, it will be immediately re-routed to the Customer's home. In the event that the package is not found, the Customer may then request the return of the same product (within the availability period), at Haben Design's expense, or the reimbursement of the amount paid. If the product(s) ordered are no longer available at that time, Haben Design will reimburse the amount of the products affected by the carrier's loss.

DAMAGED PACKAGES

The Customer must check the condition of the package in front of the carrier and make the necessary reservations on the delivery slip in the event of partial or total deterioration. In the absence of reservations, the product is deemed to have been accepted by the Customer and may not be the subject of any dispute concerning its delivery. The Customer must inform Haben Design by email as soon as possible, so that Haben Design can take the necessary measures as quickly as possible.

ARTICLE 8: RIGHT OF WITHDRAWAL, RETURN AND EXCHANGE

8.1 Legal withdrawal period

In accordance with the provisions of Articles L.221-16 et seq. of the French Consumer Code, the Customer has a withdrawal period of fourteen (14) calendar days from the date of receipt or withdrawal of the Items to exercise his legal right of withdrawal and thus notify Haben Design of his intention to return said Item. If the Items may be subject to the legal right of withdrawal, the Customer exercising his right of withdrawal under the conditions provided for in this article in terms of the time limit and terms of return of the Items, may obtain a refund for the returned Items. Form available in General Terms and Conditions Article 10.4.

The refund will be made by the same means of payment as that used by the Customer for the initial transaction, unless specifically indicated by the Customer who would request to benefit from a credit note, valid for six (6) months from its issue. The refund will be made as soon as possible and at the latest within 14 days following the effective exercise of the right of withdrawal by the Customer. This period may however be extended by Haben Design until receipt and verification by Haben Design of the goods returned by the Customer to the address indicated on the return slip, or until receipt by Haben Design of proof of shipment of the Items by the Customer. When the period of fourteen (14) days expires on a Saturday, Sunday or public holiday or non-working day, it is extended until the next working day.

Promotion period: During promotional periods, table, bench and bar legs are neither exchangeable nor refundable.
Please read carefully the instructions on the thickness of the boards, technical characteristics of the foot, the choice of color.
Concerning the candles, they are neither refundable nor exchangeable because of the personalization.

In accordance with article L.221-23 of the Consumer Code, the right is exercised by returning the Article, only the shipping costs remain the responsibility of the Customer.

Customers may benefit from a prepaid return voucher in accordance with Article 15 hereof, and (2) in the event of a lack of conformity of the Items delivered in relation to the Order (in this case, the return costs will be borne by Haben Design).

The right of withdrawal is exercised under the same conditions from the time of the Order and before Delivery.

8.2 Contractual withdrawal period

In order to ensure customer satisfaction, Haben Design accepts returns by post to the address indicated by Customer Service or on the delivery note of the Article concerned, within a period longer than the above-mentioned legal retraction period. In this respect, the Customer has fourteen (14) days as from the date of reception of his order to retract and return his Articles. The returns of Articles beyond this period will not be accepted.

8.3 How to exercise the right of withdrawal

To do this, the Customer simply has to choose one of the following methods:

– Either by connecting to the websites www.maisonshiiba.fr and www.maisonshiiba.com, in the “Manage my orders” section of My Account: simply check the product and quantities to be returned, enter the reason for the return and validate by clicking on “Validate your return request”. A link will be available to the customer to download the prepaid label.
- Or by contacting the customer service, by the contact form, by e-mail or by telephone which will indicate to the Customer the methods to be followed, it will be able in particular to use the form of retraction appearing below

Haben Design suggests that the Customer return their products by registered mail or with additional insurance, guaranteeing, where applicable, compensation for the products up to their actual market value in the event of theft or loss of the goods. In all cases, the return is at the Customer's risk. It will be up to the Customer to keep any proof of return. The return costs are the responsibility of the customer, who is free to choose the shipping method.

ARTICLE 9: GUARANTEES, MEDIATION CLAIM

GUARANTEES

In accordance with Article 4 of Decree No. 78-464 of March 24, 1978, the provisions hereof cannot deprive the Customer of the legal guarantee which obliges the professional seller to guarantee him against all the consequences of hidden defects in the thing sold.
The Customer is expressly informed that the company Haben Design is not the manufacturer of the products presented on the sites www.maisonshiiba.fr and www.maisonshiiba.com, within the meaning of law n°98-389 of May 19, 1998 and relating to liability for defective products.

Consequently, in case of damage caused to a person or property by a defective product, only the manufacturer's responsibility can be sought by the Customer, based on the information on the packaging of said product. In addition, the company reminds you that the products, services and information offered by Haben Design are no substitute for constant adult supervision.
Haben Design cannot be held liable for any failure to comply with the legislation of the country where the products are delivered. It is the customer's responsibility to check with the local authorities the possibilities of importing or using the products or services you plan to order.

Any complaint must be made in advance by e-mail via the "Customer Service" section of the Site or by telephone to Customer Service.

If applicable, the refund will be made within 14 days upon receipt of the Article by Haben Design according to the payment method chosen at the time of the Order, either on the credit card used for the payment, or on the Customer's PayPal account, or by bank transfer. These provisions are not exclusive of the above-mentioned right of withdrawal.

ARTICLE 10: RESPONSIBILITY

The products offered comply with current French legislation and the standards applicable in France. Haben Design cannot be held liable in the event of non-compliance with the legislation of the country where the product is delivered. It is the Customer's responsibility to check with the local authorities the possibilities of importing or using the products you plan to order.
Haben Design cannot be held liable for any inconvenience or damage relating to the use of the Internet, such as a break in service, the presence of computer viruses or external intrusions and, more generally, any cases deemed to be force majeure or acts of a third party by the courts.
Hypertext links may refer to sites other than the sites www.maisonshiiba.fr and www.maisonshiiba.com disclaims all liability in the event that the content of these sites contravenes the legal and regulatory provisions in force.

ARTICLE 11: FORCE MAJEURE

Neither party will have failed in its contractual obligations, to the extent that their execution is delayed, hindered or prevented by a fortuitous event or force majeure.
Will be considered as fortuitous event or force majeure all facts or circumstances irresistible, external to the parties, unforeseeable, unavoidable, independent of the will of the parties and which could not be prevented by the latter, despite all the efforts reasonably possible.
The party affected by such circumstances shall notify the other within ten business days of the date on which it became aware of them.
The two parties will then come together, within one month, unless this is impossible due to force majeure, to examine the impact of the event and agree on the conditions under which the execution of the contract will be continued.
If the force majeure event lasts longer than three months, these terms and conditions may be terminated by the injured party.
Expressly, are considered as force majeure or fortuitous events, in addition to those usually retained by the jurisprudence of the French courts and tribunals:
– Total or partial strikes, internal or external to the company, blocking of means of transport or supplies for any reason whatsoever, governmental or legal restrictions, computer breakdowns, earthquakes, fires, storms, floods, lightning;
– The shutdown of telecommunications networks or difficulties specific to telecommunications networks external to Customers.

ARTICLE 12: PERSONAL DATA

Visitors or Customers of the sites www.maisonshiiba.fr and www.maisonshiiba.com have the right at any time to access, modify, rectify and delete data concerning them in application of article 34 of the law "information technology and freedoms" of January 6, 1978.
When registering the Customer or placing an order, or as part of other specific operations, Haben Design offers Visitors or Customers to receive its newsletters, promotional offers, and/or to register to be informed of its exclusive sales. The Visitor or Customer may modify their subscription at any time through their personal account, or through the hyperlink at the bottom of the newsletters received by email.
Haben Design undertakes to effectively take into account changes to subscriptions and unsubscriptions to commercial emails sent by it as soon as possible, depending on the necessary processing.
Haben Design may also offer its Visitors or Customers to receive promotional offers from its partners. Haben Design may, for commercial purposes, transmit the identity and contact details of its Users or Customers to commercial partners, only to the extent that they have accepted the disclosure of their personal data. Users and Customers may change their choices on the Haben Design website at any time.
Haben Design uses data collection systems such as cookies. A cookie is a computer file stored on the hard drive of the user's computer. Cookies are used to signal a previous visit by the user to the site and to link the user to their personal data left on the site, particularly in the context of identifying the shopping cart.
